Terms & Conditions

These Terms and Conditions form the agreement between Serge Fagelman (the “Artist”) and the Client for the provision of live performance services at the Client’s event.


DEFINITIONS
  • “Artist” – Serge Fagelman, the performer engaged to provide musical services.

  • “Client” – The individual or organisation entering into the agreement for the Artist’s services.

  • “Event Date” – The agreed date of the performance.

  • “Booking Fee” or “Deposit” – A non-refundable advance payment made by the Client to secure the Artist’s services.

  • “Balance” – The remaining payment due to the Artist, excluding the Booking Fee.

  • “Proposal” – The document or digital quotation outlining the performance details and fee structure.

  • “Technical Rider” – A list of technical and logistical requirements needed for the Artist’s performance.


1. THE CONTRACT

This booking is negotiated by the Artist with the Client, and both parties agree to abide by these Terms and Conditions. Any reference to “the Client” shall include the person or organisation responsible for the booking.


2. BOOKING CONFIRMATION

Bookings are confirmed upon the Client’s electronic acceptance of the Proposal and payment of the Booking Fee (also referred to as the “Deposit”). Once confirmed, both the Client and the Artist shall be bound by these Terms and Conditions.


3. AUTHORITY TO SIGN

The person signing or confirming this contract on behalf of the Client must have authority to bind the Client. If they do not, they will be personally liable for all payments due.


4. BOOKING FEE

The Booking Fee is a non-refundable advance payment that secures the Artist’s services for the Event Date. It is payable via bank transfer upon confirmation of the booking (an invoice can be provided upon request). Failure to pay the Booking Fee may result in the Artist treating the booking as cancelled by the Client. In such case, Clause 6 shall apply.


5. CONTRACTS

Upon digital acceptance of the Booking Form or Proposal, this forms a live and binding contract. Any cancellation thereafter will invoke Clause 6.


6. CANCELLATIONS

a) Cancellation by the Client: All cancellations must be made in writing. The Booking Fee is non-refundable. In addition:

  • i) If cancelled within 90 days of the Event Date, 50% of the remaining balance will be payable.

  • ii) If cancelled within 30 days of the Event Date, 100% of the remaining balance will be payable.

Cancellation fees must be paid within 7 days of notice. Postponements shall be treated as cancellations unless the Artist agrees otherwise in writing.

b) Cancellation by the Artist: Cancellation by the Artist is not permitted except in cases of Force Majeure (Clause 10) or by mutual written agreement. If the Artist cancels, all fees paid by the Client will be refunded in full.


7. BALANCE PAYMENT

The balance must be paid no later than 30 days before the Event Date, unless otherwise agreed in writing. Failure to do so may result in termination of this agreement by the Artist without refund of the Booking Fee. The Client will still be liable for cancellation fees under Clause 6.


8. LATE PAYMENTS

Late payments will incur a £100 late payment fee. Any unpaid amounts may be referred to a recovery agency and will be subject to additional charges including legal and collection fees, which will be the responsibility of the Client.


9. CHANGES TO CONTRACT

Any changes must be agreed in writing by the Artist. Changes may affect the Booking Fee or overall cost. Changes made without the Artist’s agreement are not valid and are undertaken at the Client’s own risk.


10. FORCE MAJEURE

In the event of Force Majeure (including but not limited to: war, fire, death, serious illness, epidemic, strike, natural disaster, civil unrest), neither the Artist nor the Client shall be liable for any failure to perform obligations under this contract. The Booking Fee remains non-refundable.


11. TRAVEL & ACCOMMODATION (WHEN APPLICABLE)
  • For events located over 100 miles from Manchester, the Client shall provide:

    • Either 45p per mile (return journey) if driving; or train travel and taxis.

  • For international events, the Client shall provide:

    • Return flights;

    • Airport transfers to/from venue and accommodation;

    • Accommodation for the night before and night of the event (minimum);

    • On-site transportation if required.

    • Accommodation must be in a 5-star hotel or equivalent, unless otherwise agreed.

    • A meal and refreshments must be provided on the day of the event.

Flight Class Requirements:

  • For events in Europe, economy (coach) class flights are acceptable.

  • For events in the USA, Far East, Asia, or Oceania, the Artist will only fly business class or first class, unless otherwise agreed in writing.

Travel arrangements must be finalised at least 14 days before the Event Date.


12. RECORDINGS

The Artist reserves the right to record audio and video of the performance and use it for promotional purposes unless the Client objects in writing before the Event Date. If a professional recording is made, the Artist may request a copy and use it for marketing unless otherwise agreed.


13. TECHNICAL RIDER

The Artist will provide a Technical Rider in advance for the client to pass onto the sound/production company for sound requirements for the performance. This can be viewed online here >>. In-ear monitors are required (pack only; Artist provides earphones).

The Client is responsible for equipment hire and all associated costs.


14. PERFORMANCE CONDITIONS
  • The Client shall ensure the performance area is safe, sheltered, and suitable.

  • Access to a private space for preparation and a secure storage area for valuables is required.


15. MEALS & REFRESHMENTS

A suitable hot meal and refreshments shall be provided for the Artist and any accompanying musicians unless agreed otherwise in writing.


This document is legally binding upon confirmation by the Client.
